I wrote to Acu Gen yesterday asking how..you know what i am just going to post the email I send them and their response, I am so freaking mad!

My baby is due in about three weeks.  I just had another ultrasound today that shows I am still having a girl.  I know you changed your guarantee policy so that you now require a heel stick of the baby’s blood.  My address has not changed and I have no problem sending a copy of the birth certificate.  I would like to have the heel stick done when the nurses are doing routine hospital procedures so I do not have to prick my baby’s heel.  How am I supposed to get this heel stick of blood to you?  Is there a blood collection card I need to get from you ahead of time?  If so, can you please send it to me?

I was under the assumption that since I purchased and used your product before the policy was changed that I would still be under the original guarantee.

You may find it helpful to know that under the Attorney General's 940 Code of Massachusetts Regulation 3.13 (4)(c):

 "It is unfair and deceptive trade practice: ...To fail to perform any promises made to a buyer in connection with the refund, return, or cancellation privileges." At the time of purchase.

It is my understanding that under this law I would abide by your original guarantee and only provide a birth certificate in order to receive my 200% refund.  However, I have a feeling you will try to get me to deal with the new rules you have put up on your website which is why I would like to be prepared ahead of time.  Can you please advise me of the following:

1)       When your guarantee policy text was changed

2)       How to go about getting you a sample of my child’s blood after they are born

3)       If you will send me some sort of blood collection device to send to you

Dear Jennifer,
 
The chance that you will give birth to a baby of different sex than the molecular genetic results that we gave you is close to zero.  We have not seen a single discrepancy yet in many years and it will not happen in geological time scale unless the molecular evolution needs to be reinvented.   The heel stick is required only when there is a concern of fraudulent behavior.  As you probably know, consumer fraud is a crime. 
 
Acu-Gen Biolab has not changed its guarantee policy since we value the promises and reputation more than simple commercial interest.  However, please be advised we are determined to prevent any attempt to damage our superiority in many fronts and will pursue relentless individuals trying to use fake certificate unscrupulously for personal advantage.

Wow thats just insane. I hope you ladies get a lawyer and stick it to them bad if they don't provide the refund. Also maybe all those who have recieved a refund and have given birth to the oppisite gender could mail the proof to one person like Maureen and then all that proof could be copied and sent to the today show and various other news outlets. Maybe the Today show when faced with all the wrong births and seeing the promoted something PROVEN as wrong or a fraud will listen up. If they don't perhaps those who bought it because they saw it there should consult a lawyer about thier liablity for pushing a fraudenlt product. Good luck ladies

I agree with Mara!  I think we need to compile all the evidence we have that proves they have in fact been wrong and have in fact paid out refunds and send it to some type of news outlet.  I'm sick of their lies and deceptive advertising.

This is unbelievable.  Again -- who exactly do they have in charge of their PR?

So...what they're saying is (1) There's no way we're having a baby the opposite gender of what they've told us. and (2)  If it is the opposite gender of what their test says, we must be trying to defraud them.

Wow!   That infurates me!!!!!!!!!!  Do they know what they are doing is a crime????  I cannot believe that response!!!  I am more fired up than ever now to plan a group trip to The Today Show and picket or something.  We need to do something!!!!!!  UUUUUUUGGGGGGGGGGGHHHHHHHHHH!!  I'm so sorry this happened to you!!!!!

Ok so, what he is saying is that the 8 or 9 women on this site alone that have recently given birth to the opposite of what Dr Wang saw in his crystal ball are all lying?   So all of these women are so dishonest that not only did they lie for the past 4 months (that is how long I have been reading these posts) but they also then dressed their baby boys up like girls, took their pictures, and sent them in?  Is that what he is saying......surely not because that would be completely CRAZY!!!!   

I was told boy several times by BGM but 11 ultrasounds (some in 3D) all clearly show a girl.  If by some chance I give birth to a boy in 3 weeks then I can't imagine that I would be so out of my mind as to dress up my new infant son in a pink dress and big bow on his head simply to cause problems for Acu-Gen.  Let's be honest, I would like to get the other $275 that I have been promised but it isn't worth going over the edge like that to get it. I would feel like a complete whack job.

I tell you what, how about if we get Dr Wang to stick his heel so we can determine if he is even human.  I still can't believe that a human being would continue to inflict this kind of emotional abuse on someone else.....especially since I don't think any of us have ever done ANYTHING to him to deserve this.

Hey Jenalice...what 30 day notice?  I talked to 'Philip" from "customer service" twice.  He said today that he was sending my complaing/request (I told them they had all they needed on the birth certificate to confirm kinship and they were not getting Lauren's blood) upstairs to the manager.  He told me he wasn't sure who the manager was...Nice.  Let me know what 30 day notice you're talking about, please.  Thanks!!

YOU NEED TO FILE A COMPLAINT WITH THE BETTER BUSINESS BUREAU.  That is the agency that is responsible for monitoring such behavior.  The more people that file a complaint, the better.  I filed one which resulted in my getting my refund before my baby is born but the response from Acu-Gen was RIDICULOUS.  I will be posting it shortly.  At least if you file a complaint there will be a written record of this insanity.  None of us should have to deal with this.

The parts that burns my biscuit is I was simply looking for answers and he is accusing me of trying to FRAUD HIM OUT of my deserved refund IF I give birth to the girl I know I am carrying!  And to use the jargon he used to try to confuse me is just ridiculous, I am NOT stupid and my brother has a PHD in Chemistry.  Nell Boyce would like to hear from anyone that has given birth and received a refund, her email is Nell Boyce [nboyce@npr.org]

I still think anyone that has a baby of the opposite sex of what Acu-gen says needs to try to get their money back the original way.  If they say no then you can follow instructions here for MA laws to get your money.  I have spoken to a lot of lawyers and the Office of Consumer affairs in MA, they all told me the same thing.

I talked to my brother yesterday and this is what he had to say:

"Nothing's impossible, but I find their claims and attitude disturbing to say the least. I skimmed the scientific portion of their site, and

I can't say if their base science is wrong, but I also have no idea if it a load of manure, either.

In either case the geologic time scale stuff is crap, snake oil and other things designed to stop you from collecting what is due to you."

I also chatted with the Baltimore Sun, the Boston Globe, Nell from NPR and I am just waiting for more.  Acu-Gen can be as stupid as they want, I will tell everyone that will listen about this.  I am tired of being blamed for their wrong doing, like because I trust something that is in front of my eyes, I am wrong and shouldn't do that.

Thanks for the link for the 30-day notice.  I'll get on that tomorrow.  I have filed a complaint with the BBB and spoken with Nell as well.  I'm just not too sure what there is left to do.  Philip from AcuGen told me someone in "management" would call later this week.  I'm sure I won't get what I want.  Honestly, this whole thing is just emotionally exhausting.  I'm having trouble functioning as it is with the lack of sleep a newborn causes without the stress of this whole process.  But, I'm determined to hang in there and do all I can do (although it's obvious Dr. Wang thinks I'm one of the consumer fraud people).

This is absolutely amazing!!!  The self-righteous tone of that email was really quite psycho!  It's like we're dealing with mad scientists!  (Of course, I say "we" and I don't even know if my results are actually wrong yet!).  Anyway, I really think we should compile something and send it to The Today Show.  After all, the least The Today Show can do is take back their unabashed endorsement of these freaks since most of us wouldn't have purchased this test but for The Today Show's endorsement of them.  We should send them all of Acu-Gen's crazy emails, the list of "wrongs" as we have them on this site (and the list of "rights" to show we're fair) and write a strongly worded letter trying to get them to do something about this!

How hard is it to email The Today Show, does anybody know?  I think something quite compelling could be put together.  For them to tell you that they have never been wrong when they have already refunded money, and that can be proven, is atrocious.
